General visitor terms & conditions
These General Visitor Terms & Conditions belong to the private limited company Outlaw Events B.V. (hereinafter: 'Outlaw Events'), Chamber of Commerce number 71566716, and apply to agreements concluded with visitors of events organized by it or on its behalf. History of Hardcore is organized by Outlaw Events.
This English version is a translation provided for convenience. In the event of any dispute regarding interpretation, the original Dutch text is decisive (see Article 12.3).
Article 1 – Definitions
Outlaw Events: the private limited company Outlaw Events B.V. as well as, where applicable, its relevant affiliated companies, including the private limited companies Outlaw Events B.V. referred to as 'Outlaw Events', established and doing business in (1507 CB) Zaandam at Kleine Tocht 7-C, whose business includes (causing the) provision of services in the field of performing arts and the (causing the) organization of events and the associated activities and services.
Visitor: any natural person who is not acting in the exercise of a profession or business and who directly or indirectly concludes an agreement with Outlaw Events in connection with attending an Event, as well as anyone who is present in or around the Event Location.
Event: an occurrence, including a (music) performance and/or other manifestation, a concert, dance event, business event and/or a public or private occurrence in which one or more persons participate, organized and/or facilitated by Outlaw Events at the Event Location.
Event Location: the location where an Event takes place, which has been deployed for the purpose of the Event by Outlaw Events.
General Visitor Terms & Conditions: the present General Visitor Terms & Conditions that apply to the (legal) relationship between the Visitor and Outlaw Events.
Agreement: any agreement concluded between the Visitor and Outlaw Events in connection with attending an Event.
(Advance) Sales Outlet: an (advance) sales organization engaged by Outlaw Events for the sale of tickets for Events, including those where Tickets can be purchased online/digitally.
Ticket: proof, issued by or on behalf of Outlaw Events, demonstrating the Visitor's authorization to be present at the Event Location.
Ticket Price: the price for a Ticket, excluding any additional service and/or administration costs.
Website: the website of Outlaw Events (www.outlawevents.nl) and any specific affiliated website(s) of Events registered in the name of Outlaw Events.
Article 2 – Applicability
2.1 These General Visitor Terms & Conditions apply to every Agreement concluded between Outlaw Events and the Visitor, regardless of how this Agreement is concluded, as well as to every visit by the Visitor to the Event Location.
2.2 Outlaw Events has the right to amend these General Visitor Terms & Conditions in whole or in part at any time. Outlaw Events will inform the Visitor of the amendments to the General Visitor Terms & Conditions in good time by announcing this on its Website. If the Visitor believes that the amendments are contrary to reasonableness and fairness, the Visitor must notify Outlaw Events thereof within 10 (ten) working days after such notification, failing which the Visitor is deemed to agree with the amendments.
2.3 Outlaw Events expressly rejects the applicability of any general terms and conditions of the Visitor.
2.4 The nullity of any provision of these General Visitor Terms & Conditions does not affect the validity of the remaining provisions of these General Visitor Terms & Conditions.
Article 3 – Offers and conclusion of the Agreement
3.1 Information, offers, communications and price quotations relating to Events and/or (the sale of) Tickets are provided or given as accurately as possible by Outlaw Events and/or third parties, orally, by telephone or by e-mail. Outlaw Events accepts no liability for any inaccuracies or incompleteness in the aforementioned communications made by Outlaw Events and/or third parties.
3.2 An Agreement is concluded at the moment the Visitor has paid for a Ticket at an (Advance) Sales Outlet engaged by Outlaw Events, and has received delivery thereof.
Article 4 – Access and Ticket
4.1 When entering the Event Location and throughout the period the Visitor is present at the Event Location, the Visitor must hold a valid form of identification and a valid Ticket, and must present these upon the first request of employees of Outlaw Events, employees of the Event Location, security personnel, police and/or other competent authorities.
4.2 A Ticket is issued to the Visitor once and grants one Visitor access to the Event and the Event Location.
4.3 If an Event is postponed by Outlaw Events to another date, for example as a result of or in connection with force majeure, the Ticket remains valid for the new date on which the Event will take place. Should the Visitor be unable or unwilling to attend the Event on the new date, the Visitor is entitled to return the Ticket to Outlaw Events or to an (Advance) Sales Outlet engaged by Outlaw Events against a refund of the fee stated on the Ticket, regardless of the price the Visitor paid for the Ticket. Service and/or administration costs will not be refunded.
4.4 A Ticket only grants the holder of the Ticket access to the Event Location. It is the Visitor's own responsibility to ensure that they become and remain the holder of the Ticket. Tickets are and remain the property of Outlaw Events.
4.5 A Ticket may consist of a document issued by or on behalf of Outlaw Events or a barcode issued by or on behalf of Outlaw Events. The barcode is a unique code provided to the Visitor via electronic communication (for example e-mail). If the Visitor has chosen to receive the Ticket in this manner, the Visitor must ensure that this Ticket can actually and safely be provided via electronic communication. Outlaw Events guarantees neither the confidentiality nor the receipt of the Ticket.
4.6 Only purchase via Outlaw Events or via (Advance) Sales Outlets engaged by it guarantees the validity of the Ticket. The burden of proof of this validity rests on the Visitor. The Visitor may be denied access to the Event Location if it appears that the Ticket was not obtained from Outlaw Events or from an (Advance) Sales Outlet engaged by Outlaw Events.
4.7 If the Visitor claims a discount when purchasing a Ticket, the Visitor must present the document entitling them to the discount.
4.8 From the moment the Ticket is made available to the customer, the risk of loss, theft, damage or misuse of the Ticket rests with the customer. The Visitor is not entitled to a refund of the Ticket Price or any other compensation in the event of loss, theft, damage or misuse of the Ticket, nor in the event that the Visitor, for whatever reason, does not use the Ticket. A Ticket once obtained cannot be returned or exchanged.
4.9 The Visitor is not permitted to (have) remove(d) and/or alter any references to copyrights, trademarks, logos, designs, trade names and/or other industrial or intellectual property rights of Outlaw Events and/or its licensors from the Tickets.
Article 5 – Prohibition on resale of Tickets
5.1 It is prohibited to (have) resell, offer for sale or provide a Ticket to third parties in any way whatsoever or for commercial purposes.
5.2 The Visitor is not permitted to (cause to) make any advertising or any other form of publicity in connection with the Event and/or any part thereof in any way.
5.3 If the Visitor makes their Ticket available to third parties free of charge and not for commercial purposes, the Visitor is in that case obliged to impose, without exception, all obligations of the Visitor arising from an Agreement or these General Visitor Terms & Conditions on those third parties. The Visitor guarantees that the aforementioned third parties comply and/or will comply with all aforementioned obligations.
5.4 If the Visitor does not comply with the obligations under this article, Outlaw Events is entitled to designate those Tickets as invalid, and the Visitor owes Outlaw Events an immediately payable penalty of € 100.00 (say: one hundred euros) per Ticket and € 100.00 (say: one hundred euros) per day that this violation continues, without prejudice to the right of Outlaw Events to additionally claim performance and/or full compensation for damages. The holder of an invalid Ticket will not be granted access to the Event or the Event Location and is not entitled to any compensation.
Article 6 – Liability
6.1 Visitors travel to and from, and remain at, the Event Location entirely at their own risk.
6.2 Outlaw Events accepts no liability for any damage as a result of the cancellation, modification or relocation of an Event, nor for any other damage, on any grounds whatsoever, which is directly or indirectly the result of acts or omissions of Outlaw Events and/or the Event Location, of persons in (one of) their employ, or of other persons employed by or on behalf of (one of) them, or of third parties, during the Event or in connection with the stay at the Event Location, unless the damage is the result of intent or gross negligence on the part of Outlaw Events.
6.3 If and insofar as Outlaw Events should be liable on any grounds whatsoever towards the Visitor for any damage suffered by the Visitor, this liability is at all times limited to direct damage up to the amount that will be paid out under the statutory liability insurance of Outlaw Events, and only if it is legally obliged to do so. In such a case Outlaw Events is moreover only liable if the Visitor notifies Outlaw Events of the shortcoming in writing without delay, whereby a reasonable period is also set to still fulfil the obligation, and if Outlaw Events continues to fall short in the performance of that obligation even after that notice of default.
6.4 Outlaw Events cannot be held liable for the loss of clothing and/or other property of the Visitor and as such accepts no liability. If the Visitor can demonstrate with concrete evidence that the loss of clothing and/or other property of the Visitor is solely the result of intent or gross negligence on the part of (staff of) Outlaw Events, Outlaw Events will, upon presentation of a valid proof of purchase of the relevant property, pay that Visitor compensation equal to the purchase amount, up to a maximum of € 250 (say: two hundred and fifty euros).
6.5 Found objects must be handed in to the person working behind the bar, the counter at the lockers or the cash desk of the Event Location. Found objects are kept in custody by Outlaw Events or the lessor of the lockers for two weeks, during which period the rightful owner may collect their lost property from Outlaw Events or the lessor of the lockers.
Article 7 – Cancellation or relocation of the Event
7.1 Outlaw Events is entitled to modify (parts of) an Event. Only in the event of cancellation of the Event in its entirety will Outlaw Events, at the written request of the Visitor, refund the Ticket Price thereof — but not the administration and service costs — to the original purchaser of the Ticket.
7.2 Outlaw Events is entitled to cancel or relocate (parts of) an Event. It is the Visitor's responsibility to check whether an Event is being/has been cancelled or relocated and what the possible new time or new location is. In the event of cancellation or relocation, Outlaw Events will do its best to ensure that, as soon as it is aware of this, the Visitor is informed thereof. However, Outlaw Events cannot guarantee that the Visitor will receive this information before the start of the Event. Outlaw Events is not liable for any damage in this respect, and is not obliged to compensate or refund the Ticket Price of the Ticket and any charged service, payment and/or administration costs and/or other costs incurred.
7.3 Tickets for Events that are relocated remain, in principle, valid for that relocated Event. For more information, please contact Outlaw Events at info@outlawevents.nl.
Article 8 – House rules of the Event
8.1 Visitors of the Event and the Event Location must be at least 18 years old. Employees of Outlaw Events, of the Event Location and/or security personnel may at all times request the Visitor to identify themselves with a valid form of identification. If and as soon as it appears that the Visitor has not yet reached the age of 18, the Visitor may be denied access to the Event and/or the Event Location.
8.2 Visitors are obliged to conduct themselves in accordance with the house rules of Outlaw Events and/or the Event Location, as well as the rules of good decency and good morals applicable in society. If, in the opinion of employees of Outlaw Events and/or the Event Location and/or security personnel, the Visitor does not conduct themselves in such a manner, the Visitor may be addressed on this by employees of Outlaw Events and/or the Event Location and/or security personnel. In case of repetition or continuation of conduct of the Visitor that is not in accordance with the said house rules and the rules of good decency and good morals applicable in society, the Visitor may be denied access to the Event and, if necessary, be handed over to the police, without the right to compensation of the Ticket Price of the Ticket and any charged service and/or administration costs and/or other costs incurred.
8.3 The Visitor is not permitted to record the visit to the Event, in any form whatsoever, on any (digital) medium whatsoever, including photographing, filming, or any other manner of making audio and/or visual recordings of the Event.
8.4 Outlaw Events reserves the right to make audio and/or visual recordings during an Event. The Visitor who attends an Event:
- a. consents to the recording and/or (re)use of their name, voice, portrait and/or image by means of audio and video display, broadcast or other form of distribution, whether or not live broadcast and recorded, including photos or other current and/or future media technologies; and
- b. grants unconditional permission for the (re)use as referred to in sub a), for an indefinite period, worldwide and free of charge; and
- c. holds neither Outlaw Events nor parties that use audio and/or visual material with the permission of Outlaw Events for commercial or non-commercial purposes liable for the (re)use of this audio and/or visual material; and
- d. waives their portrait rights, image rights and persona rights insofar as it concerns images in and around the Event Location in which they are recognizably depicted; and
- e. acknowledges that a video surveillance system is operational and agrees that, by or on behalf of Outlaw Events, video recordings of the Visitor may be made in the context of public order and safety; and
- f. acknowledges that any intellectual property rights, including copyrights and neighbouring rights, relating to the audio and/or visual material made by or on behalf of the Visitor, accrue in undivided ownership to Outlaw Events; the Visitor will, upon the first request of Outlaw Events, free of charge, provide full cooperation with any formalities necessary to effect a transfer of rights or grant of rights; Outlaw Events is at all times entitled to (cause to) use the audio and/or visual material referred to here, made by or on behalf of the Visitor, in any way whatsoever.
8.5 The Visitor is not permitted, without the express written permission of Outlaw Events, to distribute or have distributed promotional material at the Event Location, including samples, advertising and/or leaflet material, insofar as the law permits this.
8.6 At the Event Location, smoking is only permitted in the designated (smoking) area(s). Outside these (smoking) area(s), smoking is expressly not permitted.
8.7 Outlaw Events will undertake all that reasonably lies within its possibilities to safeguard the safety of the Visitor at the Event Location as much as possible. In the context of safety at the Event Location, the Visitor is therefore obliged, upon the first request of employees of Outlaw Events and/or the Event Location, security personnel, police and/or other competent authorities, to:
- a. cooperate with a search of clothing (frisking);
- b. provide access to (hand)bag(s) carried; and/or
- c. pass through a detection gate; and/or
- d. identify themselves.
8.8 The Visitor is not permitted to (unnecessarily) linger in front of emergency exits and places at the Event Location where fire extinguishers are located or other fire-retardant and/or safety measures have been taken.
8.9 The Visitor is expressly not permitted to bring to, or at least have in their possession at, the Event Location: glassware, plastic bottles, cans, fireworks, drugs, (fire)arms and/or other dangerous objects and/or substances, food and/or (alcoholic) beverages and/or (pet) animals, on penalty of confiscation of these items and/or handover to the police.
8.10 The Visitor is not permitted to affect and/or damage (the inventory of) the Event Location in any way whatsoever. If the Visitor causes damage to (the inventory of) the Event Location in any way, the Visitor is obliged to compensate this damage.
8.11 The Visitor is obliged to follow instructions, regulations and/or directions of employees of Outlaw Events and/or the Event Location, security personnel, the police and/or other competent authorities upon first request.
8.12 If the Visitor refuses to comply with the (safety) regulations mentioned in this article, the Visitor may be denied access to the Event and/or the Event Location, without the right to any compensation of the Ticket Price of the Ticket and any charged service and/or administration costs and/or other costs incurred.
8.13 Consumption vouchers or tokens purchased during the Event or during the stay at the Event Location are only valid during the relevant Event and cannot be exchanged by the Visitor. After the Event has ended, Outlaw Events will never refund the purchase amount of these vouchers or tokens. It is not possible to (re)sell consumption vouchers or tokens already purchased. Visitors are prohibited from (causing the) resale of purchased consumption vouchers or tokens.
Article 9 – Force majeure
Outlaw Events cannot be held liable for damage of the Visitor arising as a result of force majeure and as such accepts no liability. Force majeure also includes: strikes, fire, extreme weather conditions, epidemics and all other circumstances beyond the control of Outlaw Events. In the event of force majeure, Outlaw Events has the right to postpone the Event to another date or to cancel the Event.
Article 10 – Privacy and personal data
10.1 By concluding an Agreement with Outlaw Events, (personal) data of the Visitor may be collected, recorded and stored in a data file. These (personal) data provided by the Visitor are processed by Outlaw Events.
10.2 The privacy policy of Outlaw Events, which can be consulted on the Website, applies to the processing of the (personal) data provided by the Visitor. Outlaw Events handles the obtained (personal) data with care and processes these solely in accordance with the Dutch Personal Data Protection Act (Wet Bescherming Persoonsgegevens). Outlaw Events has registered any processing of the personal data of the Visitor with the Dutch Data Protection Authority (College Bescherming Persoonsgegevens) in The Hague.
10.3 By concluding the Agreement with Outlaw Events, the Visitor expressly grants permission for the processing of (personal) data in accordance with the privacy policy of Outlaw Events.
10.4 If (visual) recordings are made with security cameras during an Event, Outlaw Events may, in the event of calamities, surrender these to third parties, including the police and the judiciary.
Article 11 – Complaints
Outlaw Events will undertake all that reasonably lies within its possibilities to make the Visitor's stay during the Event at the Event Location as pleasant as possible. In doing so, Outlaw Events seeks to keep any nuisance or inconvenience for the Visitor to a minimum and to safeguard the safety of the Visitor as much as possible. Should the Visitor unexpectedly have complaints regarding the performance of the Agreement and/or the services of Outlaw Events, the Visitor can report this in writing by sending an e-mail to info@outlawevents.nl. Complaints must be reported to Outlaw Events no later than within 7 (seven) days after the date of the stay at the Event Location.
Article 12 – Disputes
12.1 Dutch law applies exclusively to these General Visitor Terms & Conditions and all Agreements to which these General Visitor Terms & Conditions apply.
12.2 All disputes, of whatever nature, arising between a Visitor and Outlaw Events as a result of or in connection with the Agreement or further agreements implementing it, will be submitted exclusively to the competent court in Midden-Nederland (Central Netherlands).
12.3 If the General Visitor Terms & Conditions are also used in a language other than Dutch, the Dutch text is decisive in the event of disputes regarding the interpretation thereof.
Additional terms
Article 13 – (Down) payment
In the event a down payment is required, the Visitor who has purchased the Ticket and paid the down payment will, as soon as possible, receive the information regarding the period within which the Ticket Price must be paid (in full). Outlaw Events will send the Visitor an e-mail for this purpose to the e-mail address known to it. If the Visitor has not fulfilled the remaining financial obligations within the period stated by Outlaw Events (at least 7 days), the Visitor is in default by operation of law. If the Visitor has not paid the full remaining amount to the Organizer in time, they are not entitled to a refund of the down payment already made.
Article 14 – Cancellation of the Event by Outlaw Events
In the event of, or on the grounds of (the consequences of), a pandemic (such as Covid-19) and/or measures advised or imposed (on those grounds) by or on behalf of a government authority, Outlaw Events may cancel the Event at any time. If the Event is cancelled, the Visitor who has purchased the Ticket and paid the Ticket Price is entitled to a refund of the portion of the Ticket Price already paid. Service and/or administration costs are not refunded.
Article 15 – Terms, measures and/or House rules
15.1 In the event of, or on the grounds of the consequences of, a pandemic (such as Covid-19) and/or measures advised or imposed (on those grounds) by or on behalf of a government authority, Outlaw Events may at any time amend the House rules and/or attach (further) conditions to access to and/or participation in the Event(/Event Location). In the event of far-reaching additions/changes to the conditions for entering the Event Location and/or to the House rules, Outlaw Events does its best to inform the Visitor in advance. However, the Organizer does not guarantee that it can inform the Visitor personally in advance in good time.
15.2 With regard to these terms, measures and (amended) House rules, Article 8 (House rules of the Event) applies accordingly.
15.3 If the Event is cancelled and/or additional conditions are attached to obtaining access to and/or participation in the Event(/Event Location), Outlaw Events does its best to inform the Visitor as soon as possible via the Website and/or Social Media. In the event of cancellation, the Visitor is also contacted via the e-mail address provided by them.
Article 16 – Website and Social Media
The Organizer advises the Visitor to keep a close eye on the Website and Social Media of Outlaw Events. The most recently available information regarding the Event will be published there.
